Service itself was fine for a Boston defendant in a California lawsuit. Well, almost fine, they kind of forgot about service for a while and then they didn't do it at different times of day, but whatever. That's not the real problem. The real problem follows. Dewsnap provided a proof of service signed under penalty of perjury under the laws of the State of California. But then defendants removed the case to federal court, so my proof of service with the California perjury statement became meaningless. I provided a new proof of service for federal court, including the "under penalty of perjury under the laws of the USA," and (obviously) stating the new federal case # but also expressly stating that the documents when served had the original California case #. Dewsnap couldn't comprehend that there's nothing improper about this. NOW the case has a federal case # but at the time of service it had a CA case #. This should not be a problem! But they refused to sign it, offered to connect me to their lawyers to discuss, but then failed to do that too despite several requests. Would not use again.
